Highlights

When liquidators take over a company that has gone into insolvent liquidation, they may find inadequacies in the auditors' work, typically failing to detect irregularities or even fraud. This webinar will review the recent authorities on auditors' negligence and discuss the following issues in the context of an action that may be commenced by the liquidators against the auditors:-

 

-  the essential elements of a claim in negligence against auditors;

-  the types of losses that could be claimed;

-  considerations applicable to different types of companies;

-  defences available to the auditors;

-  practical considerations such as costs, evidence gathering and time bar

 

The above issues will be discussed by way of case studies.

Ludwig practises mainly in the field of commercial disputes resolution, with emphasis on corporate and partnership disputes, insolvency and restructuring, and contentious probate.  Amongst his various public services, Ludwig is an examiner of the Overseas Lawyers Qualification Examination, Executive and Technical Committee Member of the Restructuring and Insolvency Faculty of the HKICPA, Member of the Law Society Insolvency Law Committee, and Panel Member of the Higher Rights of Audience Assessment Board.  He is an editor and contributor to the book: “Reforming Law Reform” published by HKU Press, and one of the authors of “Hong Kong Corporate Insolvency Manual” (4th ed) and “A Practical Guide to Resolving Shareholder Disputes”, both published by LexisNexis.  He is amongst the first solicitors that obtained the Higher Rights of Audience and is selected as a distinguished practitioner by AsiaLaw Profiles and leading lawyer by ChambersAsia in the fields of insolvency and restructuring and disputes resolution.
